Client must ensure that the Client is aware of any health requirements and recommended precautions relevant to your travel and ensure that the Client carries all necessary vaccination documentation. In some cases, failure to present required vaccination documentation may deny you entry into a country. We recommend that the Client consult with their local doctor or travel medical service before commencing your travel. Advice on health requirements may be obtained from the Department of Health leaflet Advice on Health for Travelers, which may be obtained from the Department of Health of the country that will be visited.

PERSONAL BELONGINGS

 

In all circumstances and at all times it is the sole responsibility of the Client to take care of their baggage and personal effects and Travel Tours shall not be liable for any loss of baggage/personal effects of the Client by airline/cruise/coach or any other carrier. It is advisable to carry valuables on person at all times and deposit the same in lockers, boxes etc. (whenever available). The Company or its representative/s will not be responsible for loss of valuables or for making good such loss.

LEGAL

 

If any dispute arises in relation to the agreement between you and us as constituted by these Terms and Conditions or otherwise, the laws of India will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts in New Delhi and waive any right that you may have to object to an action being brought in those courts..

NON-RESPONSIBILITY OF 3RD PARTY ARRANGEMENTS

 

The RTIPL makes arrangements with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (“Third-Party Suppliers”) to provide you with some or all of the components of your booking. Third-Party Suppliers may also engage the services of local operators and sub-contractors. Although the Redefining Tourism India Pvt. Ltd. & Divas Sojourn takes all reasonable care in selecting Third-Party Suppliers, the Redefining Tourism India Pvt. Ltd. & Divas Sojourn is unable to control Third-Party Suppliers, does not supervise Third-Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third-Party Suppliers are subject to the terms and conditions imposed by these Third-Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Supplier. You acknowledge that Third-Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and the Redefining Tourism India Pvt. Ltd. & Divas Sojourn does not warrant that any Third Party Supplier is in compliance with the laws India jurisdiction.

The Divas Sojourn is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than  Divas Sojourn and its employees.

The RTIPL is not liable for the acts or omissions, whether negligent or otherwise, of Third-Party Suppliers or any independent contractors.

If the Hotels/Resorts/Property or event is recommended by the Client Divas Sojourn will not be responsible for the services provided by them.

Bonfire is only applicable in Winter Season and the cake will be provided on the birthday of any guest falling in the Tour. This is an additional activity that will be done accordingly to the availability of the services.

FORCE MAJEURE

 

The RTIPL will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for the RTIPL failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by an Act of God, war or war-like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of, Covid-19 or SARS-CoV-2, or any other cause whatsoever beyond the reasonable control of  RTIPL or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Tour to commence or continue, any and all of which, individually and collectively, constitute “Force Majeure”.

LAW & ORDER

 

All participants in tours operated by us are expected to obey the laws and regulations of the countries visited and any failure to do so may relieve us of all obligations that we may otherwise have to you.

CANCELLATION & REFUND

 

Redefining Tourism India Pvt. Ltd. & Divas Sojourn , would not be responsible, in any circumstances, for any loss, damages, etc. that may be incurred/ suffered by you if the information provided by you in the Online Booking Form turns out to be inaccurate/ incorrect. Balance payments towards the cost of the Redefining Tourism India Pvt. Ltd. & Divas Sojourn Trip and Registration Form must reach us at least 60 days prior to the departure OR by the specific date conveyed (if any) as last day for receiving the payment for your tour. If you fail to do so, it would be construed that you are not interested in the tour. In this case you would lose your seat on the trip and regular cancellation charges as per the policy would apply.

If government imposes any travel restrictions money will be adjusted in next upcoming tour. Air tickets money will be refunded/adjusted as per respective airlines’ policy.

However, you can claim your refund as our cancellation policy only for tours which falls under this category. Our refund structure may vary according to the tours. So please confirm the policy for that particular tour via mail. No verbal communication will be considered for refund.

• 61 days before the trip: 90% refund
• 60-41 days before the trip: 70% refund
• 40-21 days before the trip: 50% refund
• 20-11 days before the trip: 30% refund
• 10-6 days before the trip: 10% refund
• Less than 5 days before the trip: No Refund
Please note if the invoice is generated, only the principle amount will be refunded as per the above policy. No taxes paid which be refunded as that amount was submitted to Goverment.

TOUR GUIDELINES

 

On payment of the balance amount in full you will receive your confirmation with final itinerary. This confirmation will be valid for your travel on the tour. Your Final documents will be issued, upon receiving your balance payment and completion of the online booking. It may be noted that the aforesaid payment does not include the cost of porter age, tips, insurance, laundry, phone calls, food and beverages or anything not specified in the itinerary of the tour. Your final confirmation entitles you to travel on the Tour.

In case of International trips, we reserve the right to retain your passport until all pending balances are cleared.

Once a tour has been booked, should you wish to change your option from one tour to another, we will do our best to meet your wishes if we have slots lets in the recommended package.

If due to any reason, the visa is not granted by the respective Consular’s office/Embassy of the country, OR there is a delay in visa processing, Divas Sojourn will not be responsible. Whatever can be possibly recovered from the package cost, if any shall be refunded.

RTIPL , reserves the right to cancel any Tour prior to the departure, without assigning any reason. In such a situation we will organize the Tour on a different date and make your bookings for the same if the alternate Tour date is acceptable to you. In case the alternate tour date is not acceptable to you, we will refund the entire amount due and payable to you, however, you will not be entitled to claim any compensation. Divas Sojourn cannot take responsibility for any cost or any fees relating to the issuance and / or cancellation of air tickets or other arrangements not done through & Divas Sojourn .

RTIPL further reserves the right to rearrange the itinerary and change the hotel, provided, the hotel is of the same category as specified at the time of booking of the Tour and the itinerary delivers what was originally promised. RTIPL further undertakes to provide all facilities and/ or inclusions committed to you at the time of booking of the Tour.

Refunds (if any) for amendments and/ or cancellations will be paid directly to you by Divas Sojourn . It would take at least 30 days to process refunds.

RTIPL would not be held responsible for occurrence of any of the following circumstances during or before the commencement of the Tour and any extra costs occurring due to these are to be borne by you: Any acts of God, like heat wave, heavy rain, floods, land slide, earthquakes, extreme bad weather etc. Any delay or cancellation of flights, ferry, trains, bus etc.

Incorrect visas or tickets done by the client OR failure by the client to purchase the same, if they have opted to organize these on their own

RTIPL the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, individuals who are intoxicated and/or under the influence of drugs leading to a negative experience for the remainder of the group. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable.

TOUR COORDINATOR / MANAGER

 

Tour Coordinator / Manager will help you to get Check-In / Check-out hotel.

He / She will help you to get transportation for the sites you want to visit.

You can inform him/her if you are not getting committed services, coordinator help to get the same as required.

Tour Coordinator / Manager may assist you to get entry tickets for Monuments, Water Park, Rides etc.

He / She can’t be present with you every time. His/her responsibility is to take to the point and help you to get the desired service up to an extent.

If you want to get the historically knowledge or want to explore the culture of that particular place you had visited, he / she can assist you to get the guide for you on chargeable basis.

If you want a person assistant throughout the tour to assist you, you can inform the company and the expense of Personal Tour Coordinator will be done by you in Advance.

Strictly misbehave with the Tour Coordinator / Manager in any manner will not be tolerated. Your trip will be considered cancelled that moment of time and no refund will be applicable for that.

If you are 60+ or for any reason you need an assistant or helping hand, you can accompany your known person only after getting approval from the company. The cost of the additional person will be borne by you.

If it’s a group tour we have fix departures from the Airport or from a mutually agreed location, so you may have to wait for the persons to join even the pickup / drop timing is not same. If you don’t want wait of other group members, the pickup / drop will be charged extra.

Tour Coordinator / Manager is responsible to take you to the parent location only as per the itinerary. Additional activities like Gandola Ride, Pony Rides, Bike Rides, Snow Sports, Paragliding, Hot-Air Balloon, Ski-Jet etc. will be at your cost and company is not responsible for any additional activity

If you are alergic to anything or on medication please inform the company prior to departure and keep you SOS medicines with you. Company will not be responsible for any mishappening.

Customers can also avail travel insurance from us or can do with any known insurance agent.

Company has right to change the itinerary at any point of time in view of the immediate / new guidelines of Government of that particular state or keeping in mind the safe of the tour members.
Company can make any changes in itinerary / schedule tour in the last moment also in view of security of its customer.

The tour itinerary is decided few month’s prior to execution, so at any point of time if any government close any location / change its policies with tourist, customer have to accept the changes

There may situation that customer will not be able to cover all the points mentioned in the itinerary, this normally happens when there is a gap between arrival timing or customer spent more time on the particular location.

The site-seeing is planned according to the approx. distance which may vary according to the traffic / new guidelines or time consumed by customer at a particular place.

If the government close / cancel any site or rides and customer has pre-booked the same. The refund will be initiation as per the government policies. Company will be liable refund the exact amount we get from the government excluding taxes.
